Welcome to Decade Dog. These Terms of Service ("Terms") govern your use of the Decade Dog website located at www.decadedog.com (the "Site") and your purchase of our products and services. By accessing the Site or making a purchase, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, please do not use the Site.
1. Eligibility
You must be at least 18 years old to use the Site and purchase products. By using the Site, you confirm that you meet this requirement.
2. Account Registration
When you create an account, you agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@decadedog.com if you suspect unauthorized access.
3. Products
Our products are dietary supplements formulated for dogs. We strive to describe products accurately, but we do not warrant that descriptions are error-free. All products are subject to availability, and we may discontinue any product without notice.
Our products are not intended for human consumption and should only be given to dogs unless otherwise indicated.
4. Subscription Services and Automatic Renewal
Please read this section carefully. It describes automatic renewal and recurring charges.
How Subscriptions Work
When you enroll in a subscription, you authorize us to automatically charge your payment method on a recurring basis for your selected products at the frequency you choose (such as every 30 days or every 60 days) until you cancel.
What You Are Agreeing To
By checking the subscription box and completing your purchase, you expressly consent to:
- Enroll in automatic recurring billing
- Have your payment method charged automatically at each renewal
- Continue receiving shipments until you cancel
Your subscription will automatically renew at the end of each billing cycle at the then-current price. We will notify you at least 7 days before any price increase takes effect.
Confirmation
After enrolling, you will receive a confirmation email with your subscription details and cancellation instructions. Please save this email for your records.
How to Cancel
You may cancel your subscription at any time through any of these methods:
- Online: Log into your account at www.decadedog.com/account and click "Manage Subscription" or "Cancel Subscription"
- Email: Send your cancellation request to support@decadedog.com
To avoid being charged for your next shipment, please cancel at least 48 hours before your next renewal date. You will receive a confirmation email within 48 hours of your cancellation.
When you cancel online, we may offer you a discount or other benefit to continue your subscription. You are not required to accept any offer. A "Cancel Subscription" button will always be visible, allowing you to complete your cancellation immediately.
5. Pricing and Payment
All prices are in U.S. dollars and do not include applicable taxes or shipping, which are calculated at checkout. We accept major credit cards, debit cards, and PayPal.
By providing payment information, you confirm you are authorized to use that payment method and authorize us to charge it for your purchase, including recurring subscription charges if applicable.
If a payment fails, we may attempt to charge your payment method again, contact you for updated information, or suspend your subscription.
6. Shipping
We ship to addresses within the United States. Shipping options and estimated delivery times are shown at checkout. We are not responsible for delays caused by carriers or circumstances beyond our control. Risk of loss passes to you when we deliver products to the carrier.
7. 90-Day Satisfaction Guarantee
We stand behind our products. If you are not satisfied with your first order for any reason, contact us within 90 days of purchase for a full refund. Email support@decadedog.com with your order number.
Refunds are credited to your original payment method within 7-10 business days after approval. You will need to return the product in order to receive your refund, in accordance with our refund policy, even if it's used.
For subscription orders, if you cancel before your next shipment, you will not be charged for that cycle. If you cancel after shipment, you may return unopened products per this policy.
We reserve the right to deny refund requests that appear fraudulent or abusive.
8. SMS/Text Message Terms
Consent
By providing your phone number and opting in, you consent to receive recurring automated marketing text messages from Decade Dog, including promotional offers, cart reminders, and product updates. Consent is not required to make a purchase.
Frequency and Rates
Message frequency varies, up to approximately 8 messages per month. Message and data rates may apply. Contact your carrier for details.
How to Opt Out
Reply STOP to any message to unsubscribe. You will receive a single confirmation and no further marketing texts unless you opt in again. You may also email support@decadedog.com to opt out.
Help
Reply HELP for assistance or contact support@decadedog.com.
Carriers
Supported carriers include AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.
Hours
We do not send marketing texts before 8:00 AM or after 9:00 PM in your local time zone.
Privacy
We will not sell or share your phone number with third parties for their marketing purposes. See our Privacy Policy for details.
9. Email Communications
By providing your email address and opting in, you consent to receive marketing emails from Decade Dog. You may unsubscribe at any time by clicking the "Unsubscribe" link in any email or by contacting support@decadedog.com. We will process your request within 10 business days.
We may still send transactional emails about your orders and account regardless of your marketing preferences.
10. Product Disclaimers
These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
The information on this Site is for informational purposes only and is not veterinary advice. Always consult your veterinarian before starting any new supplement, especially if your pet has a health condition, takes medication, or is pregnant or nursing.
Results vary. We do not guarantee specific outcomes. Testimonials reflect individual experiences and are not guarantees of future results.
If your pet experiences any adverse reaction, discontinue use and consult your veterinarian.
11. Intellectual Property
All content on the Site, including text, images, logos, and software, is owned by Decade Dog or our licensors and protected by copyright and trademark laws. You may not use our content without written permission.
"Decade Dog" and our logo are trademarks of Decade Dog LLC.
12. Prohibited Conduct
You agree not to:
- Use the Site for unlawful purposes
- Violate any applicable laws or these Terms
- Infringe on intellectual property rights
- Transmit viruses or harmful code
- Attempt unauthorized access to our systems
- Use bots or automated tools to access the Site
- Provide false information
- Engage in fraudulent activity
13. Privacy
Your personal information is handled according to our Privacy Policy, which is incorporated into these Terms. By using the Site, you consent to our data practices.
14. Disclaimer of Warranties
The Site and products are provided "as is" without warranties of any kind. We do not warrant that the Site will be uninterrupted or error-free, or that products will meet your specific expectations.
15. Limitation of Liability
To the fullest extent permitted by law, Decade Dog and its officers, directors, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products.
Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose, or $100, whichever is greater.
Some states do not allow certain limitations on liability. If such laws apply to you, some limitations may not apply.
16. Indemnification
You agree to indemnify and hold harmless Decade Dog and its officers, directors, employees, and affiliates from claims, damages, and expenses (including attorney fees) arising from your use of the Site, violation of these Terms, or infringement of any rights.
17. Dispute Resolution
Informal Resolution
Before filing any legal action, please contact us at support@decadedog.com to attempt to resolve the dispute. We will try to resolve matters through good-faith discussion for at least 30 days.
Arbitration Agreement
If we cannot resolve a dispute informally, you and Decade Dog agree to resolve claims through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.
Class Action Waiver
You and Decade Dog agree to bring claims only individually, not as part of any class or representative action. The arbitrator may not consolidate claims or preside over class proceedings.
Exceptions
Either party may bring claims in small claims court if eligible. This agreement does not prevent you from reporting issues to government agencies.
Opt-Out
You may opt out of arbitration by emailing support@decadedog.com within 30 days of first accepting these Terms. Include your name, address, email, and a statement that you opt out of arbitration.
18. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
19. Changes to Terms
We may update these Terms at any time. Material changes will be posted on the Site and, if you have an account, emailed to you. Continued use of the Site after changes constitutes acceptance of the updated Terms.
20. General
If any part of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms constitute the entire agreement between you and Decade Dog regarding the Site.
